1. Introduction

Welcome to Kythr.

Kythr LLC is a company registered in the United States that provides a platform for people to discover and join real-world activities with others nearby. Kythr offers both free and premium features, including hosting activities, boosting activities, and connecting with the people who join them. Kythr is designed to help people meet through shared activities and plans. It is not intended to be used as a dating app, hookup app, or platform for sexual solicitation. Inappropriate sexual messaging, harassment, pressure, or misuse of messaging features may result in restrictions, suspension, or permanent account deactivation. By using Kythr, you acknowledge that you have read, understood, and agreed to these Terms.

The terms "us", "we", "Company", and/or "Kythr" refer to Kythr LLC. Together, you and Kythr may be referred to as the "Parties" or separately as a "Party". By accessing or using our services on the Kythr mobile application (the "App"), our website, or any other platforms or services we may offer (collectively, the "Service" or "Services"), you agree to and are bound by this Agreement. This Agreement applies to anyone who accesses or uses our Services, regardless of registration or subscription status.

Your access to and use of our Services is also subject to our Privacy Policy, Community Guidelines, and Safety Tips, and any terms disclosed to and agreed by you when you purchase additional features or services ("Additional Terms Upon Purchase"), which are incorporated into this Agreement by reference. If you do not wish to be bound by this Agreement, do not access or use our Services.

Subject to applicable law, we reserve the right to modify or change these Terms at any time. Notice of material changes will be posted on this page with an updated effective date, and in some cases we may notify you by email or other means. You are responsible for checking this page for changes. Your continued use of our Services after changes take effect constitutes your consent to the updated Terms. Any material changes to the Limitation of Liability (Section 13) or the Dispute Resolution provisions (Section 14) will require your affirmative acceptance where required by law. We also reserve the right to change the availability of features in our subscription plans.

2. Account Eligibility; Your Responsibilities

Before you create an account, make sure you are eligible to use our Services. This section also details what you can and cannot do, and the rights you grant us.

You may not create an account or use the Services unless all of the following are true, and by using our Services you represent and warrant that:

  • You are an individual at least 18 years old;
  • You are legally able to enter into a binding contract with Kythr;
  • You are not located in a country subject to a U.S. Government embargo, or one designated by the U.S. Government as a "terrorist supporting" country;
  • You are not on any U.S. Government list of prohibited or restricted parties;
  • You are not prohibited by law from using our Services;
  • You have not been convicted of, or pled no contest to, a felony, a sex crime, or any crime involving violence or a threat of violence;
  • You are not required to register as a sex offender with any state, federal, or local registry;
  • You do not have more than one account on our Services;
  • You have not previously been removed from our Services, unless you have our express written permission to create a new account.

If at any time you no longer meet these requirements, your authorization to access our Services is automatically revoked, and you must delete your account.

You agree to:

  • Comply with these Terms, and check this page from time to time for changes;
  • Comply with all applicable laws, including privacy, intellectual property, and anti-spam laws;
  • Use the latest version of the App;
  • Review our Safety Tips;
  • Review and comply with our Community Guidelines, as updated from time to time;
  • Take reasonable measures to protect your login information.

You agree that you will not:

  • Misrepresent your identity, age, or affiliation with any person or entity;
  • Use the Services in a way that damages them or interferes with other users, our servers, or our networks;
  • Use the Services for any harmful, illegal, or fraudulent purpose;
  • Harass, bully, stalk, intimidate, assault, defame, or otherwise abuse or harm any person;
  • Post or share Prohibited Content (see below);
  • Solicit passwords or personal information from other users for commercial or unlawful purposes, or share another person's personal information without permission;
  • Solicit money or items of value from another user, whether as a gift, loan, or other compensation;
  • Use another user's account, or create a new account after we suspend or terminate yours without our permission;
  • Use the Services in connection with fraud, a pyramid scheme, or similar practice;
  • Copy, modify, distribute, or create derivative works from Member Content or Our Content without our prior written consent;
  • Use any bot, scraper, crawler, or automated means to access, retrieve, index, or data-mine the Services;
  • Reverse engineer, decompile, or disassemble any part of the Services;
  • Upload viruses or malicious code, or otherwise compromise the security of the Services;
  • Probe, scan, or test the vulnerability of the Services or any related system or network;
  • Submit reports about other users that are false, misleading, or manifestly unfounded, or abuse our reporting or appeals tools.

The license granted to you and your authorization to access the Services are automatically revoked if you do any of the above.

Prohibited Content. You may not upload or share content that:

  • Is offensive, or harasses, abuses, or causes distress to another person;
  • Is obscene or pornographic, or contains nudity or sexual content;
  • Is abusive, threatening, or discriminatory, or promotes racism, sexism, hatred, or bigotry;
  • Encourages or facilitates any illegal activity;
  • Promotes self-harm, eating disorders, dangerous challenges, or violent extremism;
  • Is defamatory, libelous, or untrue;
  • Relates to commercial activity, advertising, or solicitation not aligned with the purpose of the platform;
  • Contains spam or any malicious code;
  • Infringes any third party's rights, including intellectual property or privacy rights;
  • Was not created by you, unless you have permission;
  • Includes the image or likeness of another person without their consent;
  • Depicts, includes, or sexualizes a minor.

Uploading or sharing Prohibited Content may result in the immediate suspension or termination of your account. Our Community Guidelines form part of these Terms and describe what content and conduct is acceptable on and off the App. You agree to comply with them, as updated from time to time.

You can create an account by signing in with Apple, Google, or your email address. When you sign in with Apple or Google, you authorize us to access and use your name from that account.

Verification. To help keep Kythr free of fake and automated accounts, we may ask you to complete a liveness check — for example, a real-time selfie or camera prompt that confirms a real, live person is present. We use liveness checks only to verify that a genuine person is using the account and to prevent fraud; a liveness check is not a criminal background check or an identity check against external databases. The check runs entirely on your device — we do not collect, store, or transmit any photo, video, or biometric data from it, and only the result (whether the check passed) is used to verify your account.

Content moderation and child safety. We may use automated tools and human review to detect content or conduct that may violate these Terms or our Community Guidelines. Automated systems may flag content that appears to violate our policies (for example, harassment, scams, or spam), and our team may then review the relevant content to determine whether a violation occurred. We do not read private messages except when they are flagged by our filters or reported by users. We maintain a zero-tolerance policy for child sexual abuse material (CSAM). Where required by law, we report suspected CSAM to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement.

We reserve the right, at our sole discretion, to suspend or terminate any account, restrict access to the App, or use any operational, technological, or legal means to enforce these Terms (including blocking IP addresses), at any time without prior notice except where notice is required by law. If your account is terminated or suspended, you will not receive a refund for any paid features already charged.

3. Content

You should understand your rights and responsibilities regarding the content on our Services, including any content you provide.

While using our Services you will encounter: (i) content you upload or provide ("Your Content"); (ii) content other users upload or provide ("Member Content"); and (iii) content Kythr provides ("Our Content"). "Content" includes all text, images, video, audio, and other material on our Services, including profile information and messages.

3a. Your Content

You are responsible for Your Content. Do not share anything you would not want others to see, that violates this Agreement, or that could expose you or us to legal liability.

You are solely responsible and liable for Your Content, and you agree to indemnify and hold us harmless from any claims connected to it. You represent that the information you provide is accurate and that you will keep it up to date. You may not post any Prohibited Content, and Your Content must comply with our Community Guidelines. Do not display personal contact, banking, or payment information — whether yours or another person's — in your content. If you choose to reveal personal information to other users, you do so at your own risk.

Your profile will be visible to other users, so make sure you are comfortable sharing Your Content before posting. You acknowledge that other users may view and share Your Content. By posting Your Content, you represent that you have all necessary rights to do so, and you grant us the license described in Section 7. We may monitor, review, remove, edit, limit, or block access to Your Content at any time, at our discretion, but we are not obligated to do so.

3b. Member Content

Member Content belongs to the users who post it, not to you. You may use Member Content only within the Services as intended — to communicate with and meet other people — and you may not copy it, use it for commercial purposes, or use it to spam, harass, or make unlawful threats. Member Content may be inaccurate, offensive, or misleading; other users are responsible for their content and for any decisions you make based on it. We may terminate your account if you misuse Member Content.

3c. Our Content

All other content on our Services — including text, graphics, user interfaces, logos, images, and other intellectual property, and the "Kythr" name and marks — is owned by or licensed to Kythr and protected by applicable laws. We grant you a limited license to access and use this content as provided in these Terms, and we reserve all other rights.

3d. Boosted and Sponsored Activities

From time to time, activities may be boosted or otherwise promoted within the App, whether by users using paid features or by third-party partners ("Boosted Activities"). Boosted Activities may appear alongside other activities and may be labeled as boosted, promoted, or similar. Boosted Activities are provided for information only. We do not endorse or guarantee any activity, and any transaction or experience arising from one is solely between you and the relevant user or partner. We may modify, suspend, or remove any Boosted Activity at any time.

4. Inappropriate Content and Misconduct; Reporting

Kythr is built on respect. We do not tolerate harassment, discrimination, scams, or harmful behavior — on or off the platform.

You agree to treat others with respect and follow our Community Guidelines, to use accurate information in your profile, and to comply with all applicable laws. You must not harass, bully, stalk, threaten, or abuse others; post fraudulent, hateful, or unlawful content; solicit money or items of value from other users; use bots or scrapers to collect data; or submit false or malicious reports.

We reserve the right to remove content, suspend or terminate accounts, or take any other action necessary to protect users and the platform, including for misconduct that occurs off-platform, such as at in-person meetups arranged through Kythr.

If you see something concerning, report a user or activity directly through the App, or contact us at contact@kythr.com. We may cooperate with law enforcement when legally required. If your account or content is restricted or removed, you may request a review within 30 days by contacting contact@kythr.com.

5. Privacy

Privacy is important to us, and we have a separate policy about it that you should read.

For information about how we collect, use, and share your personal data, please read our Privacy Policy. By using our Services, you agree that we may use your personal data in accordance with it. Kythr may use an on-device liveness check to confirm that accounts belong to real people; this check runs on your device and does not collect, store, or transmit any images or biometric data. Kythr uses your device location to show you activities nearby and how far away they are, and does not share your location with other users. You are responsible for your privacy settings. Kythr also provides engagement features; for example, Kythr Plus subscribers can see who has viewed their profile. You can adjust visibility settings in the app at any time.

6. Rights You Are Granted by Kythr

For as long as you comply with these Terms, Kythr grants you a personal, worldwide, royalty-free, non-assignable, non-exclusive, revocable, and non-sublicensable license to access and use our Services for their intended purpose, as permitted by these Terms and applicable law. This license and your authorization to access the Services are automatically revoked if you fail to comply with these Terms.

7. Rights You Grant Kythr

You own the content you provide to Kythr, but you grant us the right to use it as described in this Agreement.

By posting Your Content, you grant Kythr a worldwide, royalty-free, sublicensable, and transferable license to host, store, use, copy, display, reproduce, adapt, edit, publish, and distribute Your Content in connection with operating, providing, and promoting the Services, in any format or medium now known or later developed. This license is non-exclusive, except that it is exclusive with respect to derivative works we create through the Services (for example, screenshots of the Services that include Your Content). This license ends when you delete Your Content or your account, except for content others have already shared or that we must retain for legal, safety, or moderation purposes.

So that we can help prevent misuse of Your Content outside the Services, you authorize us (but do not require us) to act on your behalf regarding infringing uses of Your Content, including sending takedown notices under the DMCA. In consideration for using our Services, you agree that we and our partners may display boosted, promoted, or sponsored activities within the App. If you send us suggestions or feedback, we may use them for any purpose without compensating you.

You agree that we may access, preserve, and disclose your account information and content if we believe in good faith that it is reasonably necessary to comply with the law or legal process, enforce these Terms, respond to claims, protect the safety of any person, or investigate fraud or wrongdoing.

8. Purchases and Automatically Renewing Subscriptions

You will have the opportunity to purchase products and services from Kythr. If you purchase a subscription, it will automatically renew — and you will be charged — until you cancel.

Kythr is free to join and use, including joining unlimited activities. We also offer paid options:

  • Kythr Plus is an auto-renewing subscription that unlocks premium features such as hosting more than one activity at the same time (free accounts can host one active activity at a time), seeing who has viewed your profile, monthly Activity Boost credits, and an ad-free experience.
  • Activity Boosts are credits that feature one of your activities at the top of Explore for a limited time, shown with a "Featured" badge. Boost credits can be purchased by any user and are also included each month with Kythr Plus.

Purchases are made through the Apple App Store or Google Play. The price and billing period are shown at the point of purchase.

If you purchase a subscription, it will automatically renew at the then-current price until you cancel, in accordance with the terms disclosed at purchase. If you cancel, you keep your benefits until the end of the current period, after which it expires. Because Kythr can be used without a subscription, cancelling a subscription does not delete your account; to delete your account, see Section 9. You manage and cancel subscriptions through your Apple or Google account settings.

8a. Refunds

Generally, all purchases are final and non-refundable, and there are no refunds or credits for partially used periods, except as required by applicable law.

  • EU, EEA, UK, and Switzerland: you are entitled to a full refund during the 14 days after a subscription begins, in accordance with local law.
  • If you subscribed using your Apple ID, refunds are handled by Apple. To request one, go to Settings, tap your Apple ID, then Media & Purchases, then Purchase History, find the transaction, and select "Report a Problem," or contact Apple Support. For purchases through Google Play, contact Google Play support.
  • For any other purchase, contact us at contact@kythr.com with your order details.

9. Account Termination

You can delete your account at any time in the App under Settings. You must separately cancel or manage any purchases through Apple or Google to avoid additional billing.

We reserve the right to investigate and, if appropriate, suspend or terminate your account without a refund if we believe you have violated these Terms, misused our Services, or behaved in a way we regard as inappropriate or unlawful, on or off our Services. We may do so at any time, without liability and without the obligation to give you prior notice.

If your account is terminated by you or by us for any reason, these Terms remain enforceable between you and Kythr, and you will not be entitled to any refund. Your information will be maintained and deleted in accordance with our Privacy Policy.

10. No Criminal Background or Identity Verification Checks

While Kythr may use an on-device liveness check to confirm that a real person is using an account, we do not conduct criminal background checks or identity checks against external databases or public records, and we make no guarantees about any user. Always use your best judgment and follow our Safety Tips.

KYTHR DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS OR IDENTITY-VERIFICATION CHECKS ON ITS USERS, AND DOES NOT OTHERWISE INQUIRE INTO THE BACKGROUND OF ITS USERS. KYTHR MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT, IDENTITY, INTENTIONS, LEGITIMACY, OR VERACITY OF ANY USER.

YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS. WE CANNOT AND DO NOT GUARANTEE YOUR SAFETY, AND WE ARE NOT A SUBSTITUTE FOR FOLLOWING OUR SAFETY TIPS AND SENSIBLE PRECAUTIONS. ALWAYS USE YOUR BEST JUDGMENT WHEN COMMUNICATING WITH OR MEETING OTHER PEOPLE.

11. Disclaimer

KYTHR PROVIDES OUR SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS AND, TO THE EXTENT PERMITTED BY LAW, MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT OR USER IS ACCURATE, SAFE, OR APPROPRIATE. WE MAKE NO GUARANTEES ABOUT THE NUMBER OF USERS OR ANY USER'S ABILITY, DESIRE, OR CONDUCT.

KYTHR ASSUMES NO RESPONSIBILITY FOR ANY CONTENT POSTED BY USERS OR THIRD PARTIES, OR FOR THE IDENTITY, INTENTIONS, OR CONDUCT OF ANY USER. ANY MATERIAL OBTAINED THROUGH THE SERVICES IS ACCESSED AT YOUR OWN RISK.

12. Digital Millennium Copyright Act

We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (the "DMCA"). If you believe any Member Content or Our Content infringes your copyright, send a DMCA Takedown Notice to our designated agent at contact@kythr.com, or by mail to Kythr LLC, 30 N Gould St, Ste R, Sheridan, WY 82801-6317, United States, including: a physical or electronic signature of a person authorized to act for the copyright owner; identification of the copyrighted work; identification of the infringing material and where it is located; your contact information; a statement of good-faith belief that the use is not authorized; and a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act. We will terminate the accounts of repeat infringers.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KYTHR AND ITS MEMBERS, OFFICERS, EMPLOYEES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PERSONAL INJURY, ARISING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO USE THE SERVICES, (II) THE CONDUCT OR CONTENT OF ANY USER OR THIRD PARTY, OR (III) ANY UNAUTHORIZED ACCESS TO OR USE OF YOUR CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, KYTHR'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) US $100 OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF CERTAIN DAMAGES, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

14. Dispute Resolution

In the unlikely event of a legal dispute, here is how the Parties agree to proceed, except where prohibited by applicable law. The subsections below do not apply to users residing in the EU, EEA, UK, or Switzerland, who may bring claims in their country of residence under applicable law.

14a. Informal Dispute Resolution

If you have a dispute, first contact us at contact@kythr.com so we can try to resolve it. A "Dispute" is any dispute, claim, or controversy between you and Kythr arising from or relating to this Agreement, the Service, or our relationship. Before starting an arbitration or small-claims action, you agree to send us a detailed written notice of the dispute (your name, account information, a description of the dispute, and the relief sought) and to negotiate in good faith for 60 days. Completing this informal process is a condition to starting arbitration, except for individual claims of sexual assault or sexual harassment.

14b. Class Action and Jury Trial Waiver

TO THE FULLEST EXTENT ALLOWED BY LAW, YOU AND KYTHR EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO LITIGATE DISPUTES IN COURT IN FAVOR OF INDIVIDUAL ARBITRATION (EXCEPT FOR SMALL-CLAIMS COURT, OR FOR INDIVIDUAL CLAIMS OF SEXUAL ASSAULT OR SEXUAL HARASSMENT). YOU AND KYTHR EACH WAIVE THE RIGHT TO BRING OR PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS.

14c. Arbitration or Small Claims Court

Any Dispute not resolved informally will be resolved exclusively by BINDING INDIVIDUAL ARBITRATION, except that either you or Kythr may bring an individual claim in small-claims court, and individual claims of sexual assault or sexual harassment arising from your use of the Service may be brought in court. Arbitration is governed by the Federal Arbitration Act and administered by a neutral arbitration provider under its consumer arbitration rules, as modified by this section. The arbitrator decides all issues, except that a court decides the enforceability of this section.

14d. Mass Filings

If 25 or more similar arbitration demands are brought against Kythr by the same or coordinated counsel, the Parties agree to work with the arbitration provider to apply fair batching or bellwether procedures to those demands, and any applicable statute of limitations will be tolled while those procedures are followed.

14e. 30-Day Opt-Out

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing contact@kythr.com with your name, the email on your account, and a statement that you wish to opt out of arbitration. Opting out does not affect any other part of these Terms.

15. Push Notifications

We may send you emails, push notifications, alerts, and other messages about the App and our Services. After downloading the App, you will be asked to accept or deny push notifications; you can change this at any time in your device settings. You can unsubscribe from marketing emails by following the instructions in them. We may send messages needed to operate the Service, such as authentication codes.

16. Location-Based Features

The App may use your device location (for example, GPS or network) to show you activities near you and how far away they are. If you disable location access, some features may be unavailable. We do not share your location with other users. For more about how we use your information, see our Privacy Policy.

17. Governing Law

The laws of the State of Wyoming, U.S.A., without regard to its conflict-of-laws rules, apply to any Dispute arising out of or relating to this Agreement or our Services, and the Dispute Resolution provisions in Section 14 are governed by the Federal Arbitration Act. Nothing in this section limits your responsibility to comply with the laws that apply to you locally.

18. Venue/Forum Selection

To the fullest extent allowed by law, any claims that are not arbitrated or brought in small-claims court — and that are not subject to a different rule for EU, EEA, UK, or Switzerland residents — must be litigated exclusively in the state or federal courts located in Sheridan County, Wyoming, U.S.A. You consent to the personal jurisdiction of those courts and waive any objection that they are an inconvenient forum.

19. Indemnity by You

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Kythr, its members, officers, agents, and employees from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to your access to or use of our Services, Your Content, your conduct toward other users, or your breach of this Agreement. SOME JURISDICTIONS DO NOT ALLOW INDEMNIFICATION, SO SOME OF THIS SECTION MAY NOT APPLY TO YOU.

20. Acceptance of Terms

By using our Services, whether through a mobile device, application, or computer, you agree to be bound by (i) these Terms, which we may amend from time to time; (ii) our Privacy Policy, Community Guidelines, and Safety Tips; and (iii) any Additional Terms Upon Purchase. If you do not accept and agree to be bound by these Terms, you are not entitled to use our Services.

21. Entire Agreement

These Terms, together with our Privacy Policy, Community Guidelines, Safety Tips, and any Additional Terms Upon Purchase, are the entire agreement between you and Kythr regarding the Services and supersede any prior agreements, representations, or arrangements. If any provision is held invalid or unenforceable, the remainder remains in full force and effect. Our failure to enforce any provision is not a waiver of it. Your account is personal to you and non-transferable, and your rights to it end upon your death unless the law provides otherwise. You may not assign these Terms; we may assign them without restriction. No agency, partnership, joint venture, or employment relationship is created by these Terms.

22. Special Terms for Residents of Certain Locations

  • EU, EEA, UK, and Switzerland: You have the statutory rights described in Sections 8a and 14, and you may bring claims in your country of residence under applicable law.
  • United States: If additional cancellation or refund rights apply under your state's law, contact us at contact@kythr.com and we will comply with applicable consumer-protection requirements.
