1. Introduction

Welcome to Kythr ("we", "our", or "us"), where you find something to do and someone to do it with, nearby. We are committed to protecting your privacy and the security of your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our mobile application, website, and services (the "Service"). Undefined terms have the same meaning as in our Terms of Service.

2. Information We Collect

Some information is necessary to create and maintain a Kythr account; some is voluntary. If you do not provide necessary information, we may not be able to provide the Service.

Information you provide

  • Contact information (for example, your email address).
  • Profile details (for example, display name, age, city, country, interests, bio, and profile photo).
  • Content you submit (for example, activities you create and messages).
  • Reports and support requests.

Verification (on-device liveness check)

To help confirm that accounts belong to real people and to prevent fake or automated accounts, Kythr may ask you to complete a liveness check. The check runs entirely on your device. We do not collect, store, or transmit any photo, video, or biometric data from it — only the result (whether the check passed) is recorded to mark your account as verified. Because we do not collect biometric data, we do not use, sell, share, or retain any.

Content moderation

We may use automated tools and human review to detect content or conduct that violates our Terms or Community Guidelines (for example, harassment, scams, or spam). We do not routinely read private messages; human review is generally limited to content that is flagged or reported, or that we need to review for safety, security, legal, or policy reasons. We maintain a zero-tolerance policy for child sexual abuse material (CSAM) and, where required by law, report it to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement.

Information we collect automatically

  • Location: your device location — which may be precise (for example, GPS) — to show you activities near you and how far away each activity is. We do not share your location with other users. You can limit this in your device settings.
  • Usage: how you use the Service, including activities and profiles you view.
  • Device and log data: device model, operating system, app version, language, time zone, IP address, a push notification token (if you enable notifications), and diagnostic data related to log-ins, crashes, or errors.

3. How We Use Your Information

We use the information we collect mainly to provide and improve the Service. Specifically, we may use it to:

  • Provide the Service you requested.
  • Register your account and verify that accounts belong to real people.
  • Operate, improve, maintain, and secure the Service.
  • Manage and administer your subscription and purchases.
  • Show activities near you, and, for Kythr Plus subscribers, show who has viewed their profile.
  • Prevent fraud and other unauthorized or illegal activity.
  • Enforce and investigate violations of our Terms, Community Guidelines, and safety policies, including through automated and human-assisted moderation.
  • Respond to your requests and to legal or regulatory obligations.

Location data. We use your device location to show you activities near you and how far away each activity is. We do not share your location with other users, and we do not show how far away other people are. You can disable location sharing in your device settings, though some features may not work without it.

Legal bases (EEA, UK, Switzerland). Where these laws apply, we rely on:

  • Account creation, login, and core features — performance of our contract with you.
  • Showing activities nearby — your consent (for location) and our legitimate interest in providing the Service.
  • Verification, fraud prevention, and platform safety — our legitimate interests and, where applicable, legal obligations.
  • Subscriptions and purchases — performance of our contract and legal obligations (for example, tax and audit).
  • Content moderation and enforcement — our legitimate interests in safety and abuse prevention, and legal obligations.
  • Improving and securing the Service — our legitimate interests.

Automated decision-making. We do not make decisions with legal or similarly significant effects based solely on automated processing. Automated tools may flag content, but enforcement decisions are subject to human review or appeal where required by applicable law.

4. How We Share Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We may share information:

  • With other users — your display name, age, city, bio, profile photo, and activities are visible to other users, according to your settings.
  • With service providers — vendors who help us operate the Service (see Section 5), under confidentiality and data-protection obligations, limited to what they need.
  • For legal, safety, and protection — to comply with the law, law-enforcement requests, subpoenas, or court orders, and to protect the rights, safety, and property of Kythr, our users, or the public.
  • To enforce our rights — to investigate or prevent violations of our Terms, Community Guidelines, or applicable law.
  • In a business transfer — in connection with a merger, acquisition, financing, or sale of assets, where any successor must handle your information consistent with this Policy.

You meet people through activities. When you host or join an activity, the other participants can see your public profile — such as your display name, photo, and age — so you can recognize each other. Other users cannot browse people by location, and your location is never shared with them.

5. Third-Party Services (Subprocessors)

We use the following providers to operate the Service. They may access only the information needed to perform their functions and may not use it for other purposes:

  • InstantDB — database, authentication, and real-time backend.
  • RevenueCat — subscription and in-app-purchase management.
  • Expo (push notification service) — delivers push notifications to your device, routed through Apple Push Notification service (APNs) on iOS and Google's Firebase Cloud Messaging (FCM) on Android.
  • Apple App Store and Google Play — app distribution and payment processing.

Payment card details are handled by Apple or Google. We do not receive or store your full payment card information. Parts of the Service may link to third-party services we do not control; this Policy does not apply to their practices, so please review their privacy policies.

6. Data Security

While no organization can guarantee perfect security, we implement administrative, technical, and physical safeguards to protect your information against unlawful or unauthorized access, loss, or alteration. Access to personal data is restricted to authorized personnel and service providers, and data is encrypted in transit and, where applicable, at rest.

7. Your Privacy Rights and Choices

You can control your experience through the app settings and your device controls — for example, by updating your profile, unsubscribing from marketing emails, turning off push notifications, or restricting location sharing.

Depending on where you live, you may have additional rights:

  • Access and portability — request a copy of your personal information, in a portable, machine-readable format where feasible.
  • Rectification — ask us to correct inaccurate or incomplete information.
  • Erasure — ask us to delete your personal information, subject to legal and safety exceptions.
  • Withdraw consent — where we rely on consent, withdraw it at any time in settings or by emailing us.
  • Restriction and objection — ask us to limit or object to certain processing, including direct marketing.

California residents. The CCPA (as amended) gives you rights to know, access, correct, and delete your personal information, and to opt out of its "sale" or "sharing." Kythr does not sell or share your personal information. To exercise your rights, email contact@kythr.com. You may use an authorized agent, and we may need to verify your identity before responding. You may appeal a decision by contacting us with the subject "Appeal of Privacy Request." We do not show personalized ads, and we honor opt-out preference signals where required by law.

8. Data Retention

We retain your personal information for as long as your account is active and as needed for the purposes described in this Policy. If you delete your account, we delete your personal data within 30 days, except where we must retain it to comply with legal, tax, or auditing obligations, to prevent fraud, protect safety, resolve disputes, or defend legal claims. Residual copies may remain in backups for a limited time, and we may retain moderation flags, reports, and enforcement history as reasonably necessary to keep the platform safe.

9. International Data Transfers

We are based in the United States, and our providers may process your information in the United States and other countries. Where required, we rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses (and the UK Addendum), for transfers from the EEA, UK, or Switzerland to countries without an adequacy decision.

10. California "Shine the Light" Law

California residents may request information about whether we disclose personal data to third parties for their direct marketing purposes. Kythr does not sell or share personal data with third parties for their direct marketing purposes. For questions, contact contact@kythr.com.

11. Children's Privacy

The Service is not intended for anyone under 18. We do not knowingly collect personal information from children under 18. If we learn that we have, we will delete it promptly.

12. Changes to This Privacy Policy

We may update this Policy from time to time in accordance with applicable law. When we do, we will post the revised version and update the "Last updated" date. For material changes, we may also notify you by email or in-app message. Your continued use of the Service after the updated Policy takes effect constitutes acceptance.
